Terms of Service

Modern Fence Install designs and installs non-electric containment fencing for dogs, deer, and gardens. We do not install electric or shock-based systems. The scope of any specific project is defined in the proposal or order confirmation agreed to after your virtual consultation.

Marketing materials, photos, estimates, and pricing examples on the Site are illustrative. Final pricing and scope are confirmed in writing before installation.

You may reserve an installation by configuring a project and paying a 50% deposit through our secure checkout (powered by Stripe). Submitting an order is an offer to engage Modern Fence Install; we reserve the right to decline or cancel any order — for example if your property is outside our serviceable area, if site conditions are unsuitable, or if information provided is inaccurate. If we decline an order, your deposit will be refunded in full.

Once we accept your order and your virtual consultation has been completed, your install slot is reserved and the deposit becomes non-refundable (see Section 5).

The remaining 50% balance is due on or after install day, payable by the methods identified on your invoice.

You represent that you own the property where the fence will be installed, or that you have written authorization from the owner. You are responsible for ensuring our crew has safe and lawful access to the install site on the scheduled date.

Before any digging, we will arrange for public underground utility locates (e.g. 811). You are responsible for marking or disclosing private underground lines (irrigation, invisible-fence wires, septic, propane, low-voltage lighting, pool plumbing, drains, etc.). Modern Fence Install is not liable for damage to unmarked private utilities or unmapped subsurface improvements.

If site conditions encountered on install day differ materially from what was represented (e.g. ledge, dense roots, fill, additional clearing required), we may issue a written change order with revised pricing or timeline before proceeding.

You are solely responsible for obtaining any permits required by your municipality and for securing any necessary HOA or architectural-review approvals. Our fences are designed to be HOA-friendly, but we do not submit permit or HOA paperwork on your behalf and we are not responsible for fines, removal orders, or rework arising from missing approvals.

Deposits are non-refundable. The deposit reserves materials, scheduling, and crew capacity for your install. If you need to cancel after your deposit has been accepted, we will work with you in good faith to transfer the deposit to a future install date or to a different eligible project at the same address, subject to availability.

Exceptions where the deposit will be refunded:

• We decline or cancel your order before installation begins.
• We are unable to service your property after site review.
• Refund is required by applicable law.

Approved refunds are issued to the original payment method, less any non-recoverable payment-processor fees, typically within 5–10 business days.

Modern Fence Install warrants its workmanship for the period stated on your signed install agreement. Manufacturer warranties (mesh, posts, hardware) are passed through to you and governed by their respective terms.

The warranty does not cover damage caused by weather events, fallen trees, vehicle impact, vandalism, animals other than those the fence is designed to contain, third-party modifications, neglect, or failure to follow our care instructions.

Except for the express warranty above, the services and the site are provided "as is" and "as available," and Modern Fence Install disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.

To the maximum extent permitted by law, Modern Fence Install's total liability arising out of or related to these Terms or the Services will not exceed the total amount you actually paid to us for the project giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost pets, lost crops, or property damage caused by an animal escape, even if advised of the possibility of such damages.

No fence is escape-proof. While our designs are highly effective when properly installed and maintained, you remain responsible for supervising your animals and for inspecting the fence periodically for damage.

The Site and its content (text, graphics, logos, photos, layouts, and code) are owned by Modern Fence Install or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or use Site content for commercial purposes without our prior written consent.

You agree not to misuse the Site — including by attempting to access it without authorization, scraping it for commercial purposes, submitting false information through forms, or using it to transmit malware or unlawful content.

Information you submit through the Site (forms, checkout, scheduling) is used to respond to your inquiry, deliver the Services, and operate our business. Payment data is processed by Stripe and is not stored on our servers. By using the Site you consent to our handling of your information consistent with these Terms and applicable law.

You agree that we may communicate with you electronically (email, SMS, in-app messages) for matters related to your inquiry, order, install, and follow-up, and that electronic agreements, signatures, and records satisfy any legal requirement for written signatures or records.

We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of the Site or Services after a change means you accept the updated Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you and Modern Fence Install consent to the personal jurisdiction of those courts.
